1. Acceptance of Terms

By downloading, installing, or using the SketchBee mobile application ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and Biliby Pty Ltd. (ABN 86 684 097 078) ("we," "our," or "us").

2. Description of Service

SketchBee is a mobile application that converts user-uploaded images into coloring pages using artificial intelligence technology provided by third-party services.

3. User Responsibilities and Content Guidelines

3.1 Appropriate Content Only

You must only submit appropriate content through the App. Prohibited content includes, but is not limited to:

  • Nudity or sexually explicit material
  • Gore or graphic violence
  • Hate speech or discriminatory content
  • Illegal or harmful content
  • Content that violates third-party rights

3.2 Content Consequences

  • If your submitted content is rejected by our third-party processing services due to inappropriate content, you will NOT receive a refund for consumed credits
  • You acknowledge that content filtering is performed by third-party services beyond our direct control
  • Repeated submissions of inappropriate content may result in account suspension or termination

4. Image Processing and Third-Party Services

4.1 Third-Party Processing

  • Your uploaded images are processed by third-party AI services
  • We do not store your original images or generated coloring pages on our servers
  • Third-party services have their own terms of service and privacy policies
  • Processing times may vary based on third-party service availability

4.2 No Guarantees

  • We do not guarantee that all images can be successfully converted to coloring pages
  • Processing success depends on image quality, content, and third-party service capabilities

5. Purchases and Refunds

5.1 In-App Purchases

  • Credits are purchased through Apple App Store or Google Play Store
  • All purchases are subject to the respective platform's terms and conditions

5.2 Refund Policy

  • Refund requests are processed through Apple App Store or Google Play Store
  • When you request a refund, consumption data will be provided to Apple/Google as required
  • You cannot opt out of this data sharing for refund processing
  • Credits consumed for inappropriate content that is rejected will not be refunded
  • Refunds are at the sole discretion of Apple/Google and subject to their policies

6. Limitation of Liability

6.1 Service Availability

  • We provide the App "as is" without warranties of any kind
  • We do not guarantee uninterrupted or error-free service
  • Third-party service outages may affect App functionality

6.2 Liability Limitations

To the maximum extent permitted by Australian law:

  • We are not liable for any losses arising from inappropriate content submissions
  • We are not liable for third-party service failures or content rejections
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid for the App in the 12 months prior to the claim

7. Intellectual Property

7.1 Your Content

  • You retain ownership of images you upload
  • You grant us a temporary license to process your images for the sole purpose of providing our service
  • You warrant that you have the right to upload and process the submitted images

7.2 Generated Content

  • Generated coloring pages are provided for your personal use
  • You may not resell or commercially distribute generated coloring pages without permission

7.3 Themed Content and Third-Party Characters

  • The App may offer themes based on popular children's shows, characters, or franchises
  • These themed generations are created by AI and are not official products of, endorsed by, or affiliated with the original creators, copyright holders, or trademark owners
  • Themed content is provided for personal entertainment purposes only
  • We do not claim ownership of any third-party characters, shows, or franchises
  • Use of themed content does not grant any rights to the underlying intellectual property

8. Account Termination

We reserve the right to suspend or terminate your access to the App for:

  • Violation of these Terms
  • Repeated submission of inappropriate content
  • Fraudulent or abusive behavior
  • Any conduct that harms our service or other users

9. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

11. Consumer Rights

Nothing in these Terms excludes, restricts, or modifies any consumer rights under Australian Consumer Law that cannot be lawfully excluded, restricted, or modified.

12. Changes to Terms

We may modify these Terms at any time by posting updated Terms in the App. Continued use of the App after changes constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
